1. Acceptance
Batter Up is a baseball-inspired entertainment and merchandise brand operated by Strickly Unlimited (“Batter Up,” “we,” “us,” or “our”). By using this website, submitting an application, or purchasing merchandise, you agree to these Terms and applicable referenced policies. If you do not agree, discontinue use.
2. Eligibility
You must be at least 18 to independently submit VIP applications, purchase merchandise, or enter binding agreements on this site. Minors may attend eligible events only under applicable event rules and with required permission or accompaniment. We may reasonably verify eligibility.
3. Acceptable Use
Do not submit fraudulent information, compromise website security, interfere with operation, access accounts without permission, or commercially exploit protected content without authorization. We may restrict access to address unsafe or unlawful conduct.
4. Merchandise Orders
Orders depend on product availability, pricing, taxes, shipping, and checkout terms. We may correct material pricing or description errors. If a material error affects an order, we will offer the choice to accept corrected terms or cancel for a refund. An order acknowledgment is not a guarantee of fulfillment; if we cannot fulfill, we will provide an appropriate refund.
5. Payment, Shipping, Returns
Payments are processed through third-party providers, including Stripe. Our Shipping Policy and Refund & Returns Policy govern applicable merchandise transactions and are incorporated here by reference.
6. VIP Applications and Event Access
Events may be private, invitation-only, or capacity-limited. Applying, joining a mailing list, or expressing interest does not guarantee selection, invitation, reservation, or admission. Invitations and reservations require confirmation and remain subject to event rules and availability. Buying merchandise does not guarantee or confer preferential event access unless expressly stated in a specific offer. Event-specific deadlines, guest limits, and cancellation conditions will be disclosed where applicable.
7. Event Changes
Dates, venues, times, activities, and programming may change for legitimate operational or safety reasons. We will make reasonable efforts to notify confirmed participants of material changes. Terms governing paid admissions and related refunds will be disclosed before purchase, subject to law.
8. Safety
Participants must follow venue rules and reasonable safety instructions. Physical activities can involve inherent risks. We may end participation for unsafe or disruptive conduct. Nothing here excludes liability that cannot legally be excluded. Any required event waiver will be provided separately.
9. Intellectual Property
Batter Up branding, designs, graphics, and website materials are owned by Strickly Unlimited or used with authorization. No commercial reuse is permitted without authorization except as allowed by law.
10. Communications
We may send transactional and event-administration messages needed to handle your requests. Promotional communications are subject to our Privacy Policy and applicable consent requirements. You can unsubscribe from marketing communications.
11. Third Parties
Payment, hosting, email, and other providers may have their own terms. We are not responsible for independent external services beyond our control except as required by law.
12. Website Availability
We seek accurate information and reliable service, but to the extent allowed by law, the website is provided as available without a guarantee of uninterrupted or error-free operation. Mandatory consumer rights are unaffected.
13. Liability
To the maximum extent allowed by law, Batter Up and Strickly Unlimited are not responsible for indirect, incidental, special, or consequential damages arising solely from website use. This does not limit liability for fraud, willful misconduct, gross negligence, personal injury where prohibited, or other non-excludable liability.

Our Privacy Policy describes how we handle personal information, subject to applicable laws and consent requirements.
15. Governing Law and Disputes
